These Terms of Service ("these Terms") govern your use of the AI long-form writing service provided by OpenNovel ("we"). By creating an account or using the service, you agree to these Terms.
1. Service Description
OpenNovel provides AI-assisted long-form novel writing tools, including project settings, plot skeletons, chapter generation and serial continuation. Available features may vary by account type and credit balance.
2. Accounts
- You must provide a valid email and complete verification to use the service.
- You are responsible for the security of your account and all activity under it. Keep your credentials safe.
- You may not transfer, sell or share your account.
- Notify us immediately of any unauthorized use.
3. Credits and Payments
- The service uses credits to meter usage. Generation and some operations consume credits.
- You may purchase credits or subscriptions through our payment provider Creem. Prices and entitlements are shown on the purchase page.
- Payments are handled by Creem; charges, refunds and disputes follow its rules and applicable law.
- Except where required by law, purchased credits are generally non-refundable.
- We reserve the right to adjust pricing and plans; changes do not affect already-purchased credits.
4. Acceptable Use
You agree not to use the service to:
- Create content that infringes others' intellectual property, privacy or personality rights;
- Create unlawful, harmful, harassing, defamatory or violence-inciting content;
- Attempt to disrupt, reverse-engineer, scrape or interfere with the service;
- Bulk-extract data by automated means or circumvent usage limits;
- Violate any applicable law.
We may limit, suspend or terminate accounts that breach these Terms.
5. AI-Generated Content
- Output is produced by AI models and may contain errors, inaccuracies or inappropriate content.
- You should review, verify and take responsibility for final content. AI output is not professional advice.
- You are responsible for any consequences of using AI-generated content.
6. Intellectual Property
- The service interface, code and brand belong to us or our licensors.
- Content you create belongs to you, but you grant us the processing rights necessary to provide the service (such as storage, generation and sync).
- You warrant that your content does not infringe third-party rights.
7. Content Responsibility
You are fully responsible for content created, uploaded or generated under your account. We are not responsible for the specific expression of user content but may remove content as permitted by law or these Terms.
8. Service Availability
We do not guarantee uninterrupted or error-free service, which may be interrupted for maintenance, outages or third-party causes. We will restore service within a reasonable time.
9. Termination
You may delete your account at any time to stop using the service. We may suspend or terminate accounts that breach these Terms or the law. After termination you will lose access to data under the account, so back up in advance.
10. Disclaimer and Limitation of Liability
- The service is provided "as is" and, to the maximum extent permitted by law, without any express or implied warranty.
- To the extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from use of or inability to use the service.
- Our aggregate liability is limited to the amount you actually paid that gave rise to the dispute.
11. Disputes and Governing Law
These Terms are governed by the laws of the relevant jurisdiction. We encourage resolving disputes through negotiation first.
12. Changes to These Terms
We may update these Terms. Material changes will be noted in the service or on this page. Continued use of the service constitutes acceptance of the updated Terms.
